Gov. Kotek signs bill allowing medical cannabis in residential healthcare facilities
Gov. Tina Kotek just signed a bill to allow the use of medical cannabis in residential healthcare facilities and provide cannabinoid medicine training to medical service providers.

The new law expands the definition of “debilitating medical condition” for medical uses of marijuana to include the need for hospice, palliative care, comfort care or other symptom management, including comprehensive pain management. It requires specified care providers to allow the medical use of marijuana on their premises, develop policies, and provide training. It also prohibits the Oregon State Board of Nursing from disciplining a nurse who discusses the medical use of marijuana with a patient. The measure becomes operative on January 1, 2027, and takes effect on the 91st day following adjournment. While the law doesn’t take effect until 2027, this summer the Oregon Health Authority will begin to propose and adopt any new administrative rules required by the new law. Residential facilities can also begin to adopt polices before 2027.
Home health agencies, home hospice programs, hospitals, and hospital-affiliated clinics are exempt from these requirements.
While this is good news, there are still many laws that discriminate against cannabis consumers. Form employment to housing and more cannabis consumers are allowed to be discriminated against.
